Come along to the IP committee meeting where we will discuss AI IP developments and hear from one of the barristers representing Stability AI in its defence against Getty Images. We will also launch our international review of AI IP laws with the help of member contributors.
We are delighted to be joined by Edward Cronan, barrister, of 11 South Square chambers. Edward is one of the team that has represented Stability AI in the defence of copyright claims brought by Getty Images. At the time of writing, the judgment is still awaited. Edward will provide insights into what the dispute is about, what questions may be answered by the judgment, and what questions are likely to remain unanswered. Additionally, several of our members have contributed summaries of laws around the world concerning AI and IP, for our planned publication on this topic. We plan to launch this publication very soon and this will also be discussed in our meeting, with short presentations from contributing members. Tim Capel, Information Commissioner’s Office
Tim Capel is currently acting as Executive Director for Regulatory Supervision at the Information Commissioner’s Office, having previously acted as ICO General Counsel. He is responsible for leading investigation and enforcement matters, one of the biggest directorates at the ICO. This includes ensuring that the ICO is positioned to effectively regulate in the digital landscape and that its investigations, regulatory cyber, audit and assurance teams deliver their strategic plans. He has oversight of some of our most high-profile work, reporting directly to and being a part of the ICO’s Management Board and Executive Team.
Tim joined the ICO as a Legal Director in September 2022 from the Competition & Markets Authority, where he was also a Legal Director. Prior to this, Tim worked at the law firm Hogan Lovells in London as a senior associate in the Antitrust, Competition and Economic Regulation team.

Laura’s academic background encompasses both law and technology. In 2022 Laura completed an MSc in Computing Science at Imperial College London. Laura frequently writes on the topic of technology law, and in recent years co-authored the “AI and Professional Liability” chapter of “The Law of Artificial Intelligence” and “A Practical Guide to Quantum Computing and the Law”.

Synopsis: Are you mystified by the artificial intelligence and the more esoteric aspects of Generative AI and machine learning? In this session, Sonja Durager will interview Duncan Anderson, founder of Barnacle Labs and then hand the session over to the audience where you quiz Duncan on that burning issue!
As the former European CTO for IBM Watson AI, Duncan has over a decade of experience in enterprise AI and brings a career of high-profile technical leadership roles spanning several decades. A believer in ‘you cannot manage what you do not understand’, Duncan spends much of his time working hands-on with Generative AI, personally building solutions and providing broader leadership informed by his practical experiences. Duncan has been featured in Wired magazine and interviewed in a Channel 4 documentary about AI.

Session 3: Panel – AI and IP, the latest developments
Synopsis: Intellectual property is a key battleground both for AI platforms seeking to train their models and traditional content providers looking to protect investment in their assets. This is without the ongoing debate over the extent to which traditional IP rights (whether copyright, trade secrets or patents) can attach to AI generated materials. This panel will look at the global and regional trends in relation to AI and intellectual property, and examine the details of some of the more seminal judgments. How can content owners better protect their rights, and how can platforms legitimately seek to make use of web-scraped content? Our panel will seek to uncover the salient issues and work to provide practical solutions from both perspectives.

Session 4: AI issues in Commercial Disputes
Synopsis: Much of the attention in relation to AI disputes is focused on IP, and comparatively little attention is given to other fundamental issues which are peculiar to IP related disputes such as the impact of AI generated disinformation, the impact of problematic evidential hurdles such as lack of explainability and how bias and discrimination may impact liability. This is without considering the wholesale embedding of AI powered tools into litigation procedure which may ironically enhance these concerns. Our panel will look at the pervasive impact of AI on general litigation procedure and dispute resolution and give practical insights on how to mitigate and manage these risks.

A deep dive into topical issues in sourcing. This will be a guided interactive discussion focusing on case studies, and sharing market insights and discussing key areas such as liability apportionment; contract management and role of third parties; data sharing and addressing regulatory compliance; and termination triggers and consequences.
This session is designed to be an interactive, panel-led discussion on the approach to contracting for tech deals. Session 1: Top 10 Critical Provisions for Large Tech Deals: Hint – They are not what you think!
We are all familiar with the typical “last man standing” issues in negotiations: rep & warranties, indemnities, liability caps and super caps, etc. However, ironically it is not those provisions around which litigation has tended to coalesce. Instead, it is the more discrete provisions which cause the lawsuits, and therefore require more attention from practitioners. In this presentation, the speakers will collectively identify their Top 10 critical provisions for large technology deals, based on their real-word experience and on recent litigation, with a view to assisting practitioners to avoid the minefields posed by these provisions.

Session 4: AI issues in Commercial Disputes
Synopsis: Much of the attention in relation to AI disputes is focused on IP, and comparatively little attention is given to other fundamental issues which are peculiar to IP related disputes such as the impact of AI generated disinformation, the impact of problematic evidential hurdles such as lack of explainability and how bias and discrimination may impact liability. This is without considering the wholesale embedding of AI powered tools into litigation procedure which may ironically enhance these concerns. We are all familiar with the typical “last man standing” issues in negotiations: rep & warranties, indemnities, liability caps and super caps, etc. However, ironically it is not those provisions around which litigation has tended to coalesce. Instead, it is the more discrete provisions which cause the lawsuits, and therefore require more attention from practitioners. Sarah Green, Newmans Row (UK)
Sarah Green was Law Commissioner for Common and Commercial Law from 2020 to 2024. Her law reform work included the Electronic Trade Documents Act 2023, Advice to Government on Smart Contracts, the Arbitration Act 2025, Intermediated Securities, and Digital Assets. Sarah is now an Independent Arbitrator at Newmans Row, Professor of Private Law at the University of Bristol. Sarah also sits on the UK Jurisdiction Taskforce, The International Jurisdiction Taskforce, The Digital Commonwealth, LegalUK, and the Trade Digitalisation Taskforce. She was previously Professor of the Law of Obligations at the University of Oxford and a software consultant at Accenture.

Danny co-founded Preiskel & Co over 20 years ago and has over 30 years’ of telecoms experience advising internationally. He is a Chambers ranked leading communications lawyer for over 25 years and is a regular speaker at telecoms conferences, a Judge on the prestigious Capacity Awards and served on the Mobile Ecosystem Forum EMEA Board. He has been increasingly working on satellite issues, including being external counsel to a satellite regulator and leading an international working group of satellite lawyers which he hosts in his metaverse office. Previous experience includes working as an investment banker in Deutsche Banks’s telecoms team.
Elias Mühlemann
Elias Mühlemann (LL.M in Law, Science and Technology, 2018) is a managing associate with VISCHER’s TMT practice in Zurich. He supports clients in the implementation of innovative business models and complex coopera-tion structures with a strong focus on the telecommunications sector. He was engaged in the public consultation on the draft of the Swiss Space Act.

Rafael García del Poyo is a Spanish lawyer and a Partner at Osborne Clarke Spain where he heads the IT/IP Law Department. Rafael is also the TMC Sector Leader in Spain. He is currently the Secretary General of the Spanish Centre for Space Law (ESA-ECSL) and former president of the Space Law Section of the Madrid Bar Association.

Véronique has over 25 years of experience in Radio Regulations for satellite systems at the ITE, the United Nations Specialized Agency for ICTs.
Ruth Pritchard-Kelly
Ruth Pritchard-Kelly is an expert on satellite regulatory policy with over 30 years of experience. She has advised governments and industry on regulatory, spectrum, and sustainable space policy, and is currently on the Board of the Secure World Foundation and is a member of New America’s LEO Working Group. Pritchard-Kelly was the Vice President of Regulatory Affairs at OneWeb, and worked at O3b, SES, and American Mobile Satellite. She has a Master’s Degree in space and telecommunications policy from George Washington University and a J.D. from the University of Maryland. Ms. Pritchard-Kelly has advised the UN and Apple, and has served on the Boards of the US Telecommunications Training Institute, the Arthur C. Clarke Foundation, and the Commerce Department’s Spectrum Management Advisory Committee.

Peter Lind Nielsen, Bech Bruun
Peter Lind Nielsen handles all types of technology contracts within development, implementation, outsourcing, hosting, cloud computing and automation projects, etc. Peter advises on the legal aspects of procurement, development and implementation of new technology, e.g. robots and AI as well as software licensing and in particular open source licenses and the protection of data.
For 20+ years Peter has advised both customers and suppliers within tech-transactions. He is versed in contract drafting, negotiation and a very skilled litigator. Peter is certified IT-lawyer under the Danish IT-lawyers Association and member of the board of the association.

Tim Carter, CEO of Karmanline leads us on a fascinating insight into how AI is reshaping the future of film and TV storytelling, and in particular how Hollywood and other production creatives are beginning to use AI in their work. As lawyers we tend to dismiss the output of AI as derivative (from the perspective of IP) and this session will give us the opportunity to view the output of AI from a different perspective.

Tim co-founded Karmanline to revolutionise video production, connecting every creative choice to its production consequences on a compliant technology platform. This helps studios and producers handle ‘AI’, collapsing budgets, and exploding demand—all at once.
Tim comes to entertainment from law via technology over a 25 year career working internationally. He holds the unofficial record for a week’s billable hours as an Allen & Overy trainee (137.5) and advocated a multi-billion dollar merger at the European Commission using toy robots. He moved in-house from A&O’s commercial IP team to mobile OS pioneer Symbian before joining Google as UK counsel. He then switched to business roles, building global partnerships for Android. He co-founded Peek Vision, a non-profit supporting eye health programmes in low income settings, built technology partnerships with accountants for Silverfin, and protected actors from unconsented ‘AI’ at Flawless.
Tim is Non-Executive Director at HotelMap, the event hotel booking platform, International Advisor to Instituto Identidades do Brasil, Brazil’s leading antiracism organisation, and Trustee at East London Dance.
