Yes. South Dakota Codified Laws §§ 22-40-19 to -26 require disclosure of any security system breach. Although these statutes require the “information holder,” defined as any person or business . . . that owns or licenses computerized personal or protected information of residents of this state,” it indirectly applies to IT-Security as the most likely to observe any breach.
