• Under GDPR, Member States can set their own rules on penalties for infringements of data security. Member States may provide their own rules on criminal sanctions for infringement of GDPR. The criminal sanctions that apply in the UK under the DPA are set out above.
• Others - The Crown Prosecution Service has an excellent guide to cybercrime. Annex A and B specifically provide an overview of what legislation may apply to certain cybercrimes - including legislation which does not provide and specific offences but nonetheless may be relevant.
