Constitution of the Russian Federation
Article 23 of the Constitution establish the right of the individual on person’s privacy, personal and family secret, privacy of correspondence. Article 24 of the Constitution prohibits gathering of information re private life of person without the consent.
Doctrine of Information Security of the Russian Federation
Doctrine of Information Security of the Russian Federation approved by Decree of the President of the Russian Federation No. 646 dated December 5, 2016 (hereinafter referred to as “Doctrine of Information Security”) is a general document doesn’t contain any obligation but set forth policy of the Russian Federation re information security.
Civil Code of the Russian Federation
Article 12 of the Civil Code of the Russian Federation provides the methods of defense of civil rights, in particular:
- self-help;
- restoration of the position which existed prior to the violation of a right;
- suppression of actions that violate the law or threaten its violation;
- restore the situation that existed before the violation of law and suppress actions that violate the law or create the threat of its violation;
Article 1299 of the Civil Code of the Russian Federation allows the right holder to use the technical tools of protection of copyright (which are defined as any technology, technical devices or their components controlling access to the work and preventing or limiting conduction of authorized actions re works) to secure its intellectual property against illegal usage. In general, authorized removal or disabling of such tools is not permitted.
