There is no particularly prescribed offence of digital trespassing, however under the Act at Section 8, any person who directly or indirectly causes an unauthorized modification of any data held in any computer system or network, commits an offence and is liable on convic-tion to imprisonment for a term of not less than 3 years or to a fine of not less than N7,000,000.00 or to both fine and imprisonment. Modification is explained to include where a person causes program or data held in a system to be altered or erased; or where program or data is added to or removed from any system.
Section 7 also makes it an offence for a person to intercept non-public computer data or signals unlawfully by technical means, or transmissions of non-public computer data or computer system network; on conviction, the offender will be liable to imprisonment for a term of not less than two years or to a fine of not less than N5,000,000.00 or to both fine and imprisonment.
