The Mexican Institute for Access to Information and Personal Data (Instituto Nacional de Acceso a la Información y Protección de Datos “INAI”), is the authority responsible for the protection of personal data in possession of private persons. Its main function is the surveillance and enforcement of data collector’s obligations. Our Privacy Laws establish mechanisms for data subjects to enforce the protection of personal data before INAI, in the event data collector refuses to comply with its obligations and/or in the event the data subject is not comfortable with the response of the data collector.
Failure to comply with the provisions of the Privacy Laws may result in monetary penalties and imprisonment.
