As mentioned above, individuals can only resource to administrative actions, and in some particular cases, to criminal actions. Only if successful in said administrative or criminal actions, they could later on file a civil action trying to collect damages and loses.
On the other hand, as to the possibility of instituting data protection class actions, there is no express provision in this regard in Mexican data protection regulation. Nevertheless, it also has to be mentioned that INAI has been very active instituting administrative actions ex officio, which results in the benefit of various consumer’s groups.
