Survey Answer:

There is a general tort-type obligation to make good any damage caused to another. This may provide a cause of action in the event of a civil claim. Generally, a court will not impose liability on a party when that party is not at fault. A mere mistake will not result in liability. As a general exception, mistake may entail liability where negligence, rashness, failure or imprudence have been proven.
