3.2 Which authorities are responsible for enforcing the regulations under 3 and 3.1? What kind of legal instruments / rights are they furnished with (fines, audit/investigation rights, etc.)?

• FMA – Financial Market Authority – in the financial sector:
o investigation rights;
o Imposition of fines.
• Data Protection Authority – especially for the telecommunication sector:
o Right to request to perform a notification if a violation is suspected;
o Monitoring mechanisms.
• Criminal courts and administrative authorities in other cases:
o Imposition of fines/imprisonment.
