Certain Austrian laws oblige managing directors, board members or entrepreneurs to duly set up and maintain cybersecurity systems. Violation may result in administrative penalties or civil law claims for damages, however no criminal sanctions apply.
Sanctions connected to the lack of adoption of cybersecurity measures can for example be found in Art. 347 UGB (Austrian Commercial Code), Art, 84 AktG (Stock Corporation Act) or Art. 25 GmbHG (Limited Liability Company Act).
