Data Theft: Yes. Unauthorized access to restricted data under section 478.1(1) (set out above) includes “the copying or moving of the data to any other place in the computer or to a data storage device”.
Data Corruption: Yes. ‘Data Corruption’ is likely captured under section 478.1(1) of the Criminal Code, which states that it is an offence to intentionally cause any unauthorized modification of restricted data. This offence carries a maximum penalty of 2 years’ imprisonment. Modification (in respect of data held in a computer) includes (a) the alteration or removal of the data; or (b) an addition to the data.
