Yes. ‘Hacking’ is likely captured under section 478.1(1) of the Criminal Code Act 1995 (Criminal Code) which states that it is an offence to intentionally cause unauthorized access to restricted data where the person knows that the access is unauthorized. This offence carries a maximum penalty of 2 years’ imprisonment. Access to restricted data is unauthorized where the person if the person is not entitled to cause that access, with restricted data including any data that is held in a computer to which access is restricted by an access control system associated with a function of the computer.
