The Argentine Civil and Commercial Code (“CCC”) contains a general obligation to prevent damages. In particular, Section 1710 provides that all individuals must adopt, in good faith and as required by the particular circumstances of the case, reasonable measures to prevent or mitigate a damage caused by a third party. In this regard, taking cybersecurity measures could be considered as an action which prevents damages by a third party.
