Brian Hengesbaugh is a Partner in the Global Information Technology and Communications Practice of Baker & McKenzie, LLP. He focuses his practice in the areas of Privacy, Information Technology and Sourcing and is a frequent speaker and author on those topics, with particular expertise in complex cross-border privacy and regulatory compliance issues.
Brian has advised companies across multiple industries on the legal aspects of global privacy and data protection, data security, information technology, and related restrictions on data collection and movement. Prior to joining Baker & McKenzie, he was Special Council to the U.S. Department of Commerce, where he played a key role in the development and implementation of the U.S. Government's domestic and international policy in the area of privacy and electronic commerce. He was the lead attorney on the U.S. side negotiating the U.S.-EU Safe Harbor Privacy Arrangement and has represented the US Government in negotiating the UN Model Law on Electronic Signatures, in developing a draft Council of Europe Treaty on Cyber Crime, and in the negotiation of a draft Hague Convention on Jurisdiction and the Recognition of Foreign Judgments.
